Jury process: jury selection (us only, pretrial publicity (us only - largely unrestricted, jury instructions, jury decision-making ( 1 ) jury selection. Randomly selected potential jurors from voters in the area. Us sends questionnaires on opinions, ca does not. Potential jurors rejected using peremptory challenges or challenges for cause. Us can have very vague/lenient challenges, ca strict rules on removing someone from jury. Jury must be death-qualified in capital punishment cases are not against death penalty. Makes it difficult to select an impartial jury. Increases presence of jurors with bias or emotions. Both prosecution and defense have greater confidence in jury. Conspiracy to kidnap national security advisor henry kissinger. Trial resulted in only minor convictions for smuggling mail into and out of federal prison, later overturned. Trial gained fame for scientific jury selection . Jury were mostly highly religious who could sympathize with nuns/priests. Prosecution found out, did not call on defendants to testify, only called on non-religious co-conspirators.
