This is an application pursuant to section 136 of the municipal act, r. s. o. 1990, c. m. 45 for an order quashing for illegality a city of barrie interim control by-law #96-245 dated november 25, 1996 and its related resolution #96-p-154 dated november 4, 1996. The applicant is the owner of land consisting of 27. 5 acres in the city of barrie. 17. 5 acres of the site are set aside as st. mary"s cemetery of which a relatively small portion has been in cemetery use. The remainder, consisting of approximately 10 acres and being the land in issue, is vacant land which now has the appearance of a woodlot. The site is bounded on the north and south by rear yards associated with approximately 20 detached homes and on the west and east by arterial roads. The city"s comprehensive zoning by-law since 1963 has permitted educational facilities on the property.
