Week 7: capital punishment and sentencing for murder. United states vs. burns paras 1-19, 28-104, 124-144. Capital punishment puts beyond recall the possibility of correction. Marshall, milgaard, morin, sophonow and parsons were all wrongfully convicted for murder. Canada abolished the death penalty for all offences in 1998: 38 us states still practice it though. There are two offenders who the us wants extradited back to them: the extradition treaty between canada and the united states of. America permits canada to refuse the extradition of fugitives unless provided with assurances that they will not suffer the death penalty: minister of justice did not do this in this case. The offenders argue that canada"s abolition of the death penalty is a fundamental principle of our justice system: they are also canadian citizens and were 18 years old at the time of the offence. Minister says that people found to commit crimes in foreign countries forfeit the benefit of canada"s abolitionist policy.
