Roberts & grossman: ch. 1: ca= complex system of checks & balances responsibility for criminal cases divided to different decision makers guided by different mandates. Judge follow principles of proportionality to ensure severity of sentence reflects crime committed. Parole board; offenders benefit from release therefore sentence length determined on severity of crime & portion served in prison determined by other criteria: criminal justice system responded to variability of criminal conduct. Even if crime is committed together both cases are different & is appropriate for cjs to treat them differently. 1st 35 years & repeat offender = sentence 5 years. 2nd 18 & no record = 3 years probation: models of cjs. Herbert packer coined term crime control & due process. Crime control = supports giving cjs officials more powers to respond to crime. Wide range of police power to search suspects & detain accused. Due process = limits powers of cjs to prosecute accused & portects right of accused.
