Ire431 lecture 1: discussion of legal structure and an arbitration case. Ire431 chapter 36: mapping the collective bargaining regime. Common law"s treatment of collective worker activities. Torts of intimidation employers would use in courts against employees. Made it close to impossible to create these collective bargaining rights. Interlocutory injunction: courts would order unions to stop collective picketing/influencing. There were contracts that were created that would get employees to promise they wouldn"t unionize. Introduce role of government that would do industrial disputes investigations and ultimately play a role in trying to resolve issues and conciliation was born from that. Adoption of american style system called wagner model, implemented during war because there were a lot of war manufacturing and thought they"d achieve labor peace. Labor relations legislation, outputs of the collective bargaining regime, & legal. Labor relations boards: to interpret and enforce labor relations legislation enacted by governments. Comes up when parties don"t have collective agreement and trying to get one.
