Labor law refers to laws in unionized workplace. Employment law - individual relationship, non-union employee and their relationship with their employer. Work is different from other commodities - cannot be alienated, work and worker. Often last many years - terms and conditions change over time. Employment relations is hierarchal someone"s services-contract for service. Independent contractor cannot have rights of employee - when someone pays for. Hierarchal nature - more hierarchal = more of an employment relationship. Only employees are protected under employment law. Sagaz case: is no one test to decide to see if its an employment relationship - have. The level of control the employer has over the worker"s activities. Whether the worker provides his or her own equipment to look at entire relationship. Whether the worker hires his or her own helpers. The degree of financial risk taken by the worker. The degree of responsibility for investment and management held by the worker.
