Tort law: variety of private law, most generally, tort law governs various involuntary interactions between private individuals, ex. I negligently hit you with my car: you don"t ask to be hit, and the relationship that we enter into as a result of me hitting you isnt one to which you consented to. Still, tort law imposes obligations on me, and makes me liable for certain damages i thereby cause you. Contract law: compare that situation with the interactions we find in contract law, one party offers, the other party accepts, and consideration passes from one to the other; in. Caveats: of course, the distinction isn"t perfect, ex. I might decide to ski at your ski hill, buy my lift ticket, etc. but proceed to suffer injury as a result of your negligence- you failed to provide adequate signage, the ski hill was improperly groomed, etc.
