Private law is between two private parties: generally, hire their own lawyers. In the us, these motivations take place before a jury: juries in different jurisdictions have different ways of rendering a verdict. Private law, the person is not being judged in moral terms: person is being judged by whether they are civilly liable for contract breech. In negligence, someone makes a decision, is aware that it will lead to an action with certain possible consequences: it"s not criminal negligence, its civil negligence. Intentional torte doesn"t mean mens rea: it means that you have harmed me in some way. Physically or property damage: case: 7/11 someone comes in and wants to rob the store. The store owner puts his hand up and punches the guys nose and breaks his nose. The person who had his nose broken can sue for intentional torte. Strict liability deals with warranty and guarantees: services has many more people than the goods or manufacturing industry.
