I think we can accept the british north america act, 1867, as the first constitutional document in canada, as far as this course is concerned, but its not really the first. The royal proclamation of 1763 is actually a constitutional document. It set out, among other things, many of the laws that would pertain to the treatment of canada"s aboriginal peoples, as well as the basis of civil administration in the new province of quebec. For our purposes, the first constitutional document that is still in use, is the bna. Case law: judicial interpretations of constitutional documents and any case law that adjudicates the extent of government authority. Conventions: these are not actually law in the traditional sense, but can be observed or obeyed for a sufficient time that they either become law, become treated as law, or are used to interpret the law.
