2 approaches to the study of law in society. Law exists to maintain order and stability. Durkheim is especially relevant for the functinalist perspective in understanding law, society and crime. Within the society there are diverse groups and the interests may conflict with one another. Purpose of law is to control in order to maintain harmony, social integration, stability. Law was visible symbol that you could use to examine the level of solidarity within the society. Durkheim was specifically concerned with how society was held together. Mechanical found in traditional societiescloser personal ties, values were similar, similar attitudes and beliefs. Organic (cid:272)hara(cid:272)teristi(cid:272) of (cid:373)ore (cid:373)oder(cid:374) so(cid:272)ieties (cid:373)ore di(cid:448)erse groups, (cid:272)o(cid:374)fli(cid:272)ti(cid:374)g norms and values and have difference in police and attitudes. As societies change the type of law has to change as well. In modern societies we have restitutive law focuses more on compensation.
