Our laws are used as a tool for social control. Through punitive social control measure: crim you get punished, tort you need to compensate. Incapacitation: separating an offender from society, most common notion of incapacitation is incarceration. Theoretically society is safer but it is a short term solution. Deterrence: general, punish the offender so the public does not want to commit the crim, specific, when the punishment is very specific to the crime. Deterrence works for the regular people but not for certain people with extenuating circumstances or a lifer. Instrumental offences: lots of planning, terrorism, embezzlement, planned robbery. Expressive offence: emotional based, simple assault, propogation, domestic abuse. Amateur commitment: shoplifting, level 1 assaults, petty theft, low commit more likely to be deffered. Medicalization: controlled through regulations, medical system, if you complete this program youll get something out of it, medicated, etc.
