Heather crow: worked in restaurants that allowed smoking within their restaurant. She then got lung cancer and went on a mission to have a law passed to ban smoking within establishments. In four days after she passed away, the smoke free ontario act came to effect in ontario. This act banned smoking in enclosed public places and workplaces and in motor vehicles with children under 16. This occurs when there are no other similar cases that the courts can draw upon. So they look through previous cases that can help draw an analogy to the facts they have at hand. For example: case of miners eating someone and case of someone stealing bread because he"s hungry. Sect 253 of criminal code says if you"re impaired you can"t operate a vehicle. Case of guy who waits in his car with it in park he was drunk .
