Document Summary
Theoretical perspectives & intro to origins of law. Ideology is a tool of persuasion: law as functionally integrative: emphasis placed on the positive (integrative) rather than negative (coercive) dimensions of law, this emphasis becomes central to the hegemonic process. In the gp morin case, we were presented with examples of how individuals in the system failed guy. It is easier(cid:455) to (cid:271)la(cid:373)e individuals than to question and assume that the whole system did it. I. e. , the (cid:449)o(cid:373)e(cid:374)(cid:859)s protest, or lgtbiq rights: even if the law is not perfect all the time, there are ways to change it, relation to hegemony. In order to maintain legitimacy, lawmakers must factor in historical context, and how much influence diverse groups will have in the process. It must at least (cid:862)appear(cid:863) that these groups will be served, or the legitimacy and dominance of those in power is jeopardized: law therefore takes on a dual nature.
