Must be rather than what is: what he seems to mean is that it is in our current world but that it would also be in other worlds governed by the same principles. A sign, or representamen, is something . which i have sometimes called the ground of the representamen. (p. 99, italics in original: five terms, sign, representamen (sign vehicle, object, ground (broader set of ideas against which a specific sign is formed) A qualisign is a quality which is a sign. A legisign is a law that is a sign. This law is usually established by men [sic].
