Some states were not all welcoming so they created black codes- diff from jim. Crow laws: prohibit participation on the basis of the color of your skin, they erode the rights of aa given by their citizenship. Sc responds only when cases make their way to them ( strauder v wv) so. Congress sees they need to do something to promote the protection of aa rights: they pass the 1866 civil rights acts to prevent black codes, did that by justification under the 13th amendment section 2. At the end there is a clause the authorizes congress to implement this amendment similar to necessary and proper clause: this law focused on property rights. They are no longer treated as property and they can get married.
