Treason is defined in article iii section 3. The constitution provides that only the person guilty of treason is to be punished. The punishment for treason is established by congress. Judicial review- the power of courts to determine the validity of governmental acts. 1789- congress passes judiciary act of 1789 establishing court system and providing certain powers to federal courts. 1801- lame-duck federalist congress passes judiciary act of. 1801- creates lots of new federal judgeships (they did this because the federalists would no longer have power in congress or have the president, so they created these judgeships to pack their people into the office) Adams to one of these judgeships and he is confirmed by the senate. Now he is just waiting for his official commission. 1801- jefferson assumes presidency; madison is sec. of state. (they never sign. Marbury to be a judge because they don"t want him in office, marbury gets mad)
