HI410 Lecture Notes - Lecture 6: Establishment Clause, Baptists In The History Of Separation Of Church And State
Document Summary
The establishment clause can be interpreted many ways. Describe the kind of wall you could use to represent it: literal interpretation anything goes as long as the government doesn"t establish an official religion. (so it can partake in religious activities if it wants) Easy to penetrate and get around: narrow interpretation the government cannot advocate a single religion, but it can acknowledge the idea that there is a religion. (ex: writing in god we trust" on money) 1: broad interpretation except for basic human rights, the government cannot take part in any religion. Is the action irresponsible: remember danger, public health, and slander/libel proved by evaluating time, place, manner and content, example: yelling fire in a movie theater endangers public health because of the place. Jefferson feels that the first amendment prohibits the government from creating a national religion. Jefferson was very stoic about the fact that 98% of americans are christian.
