Trials are a means of dispute resolution that are very expensive and sometimes take many months to resolve. There are alternative dispute resolution (adr) methods to resolve disputes that are inexpensive, relatively quick and leave more control with the parties involved. Conciliation: 3rd party assists in reconciling differences. Settling by 3rd party who renders a legally-binding decision. Non-profit organization: american arbitration association, better business bureau, trade organizations. Next comes hearing from both parties and finally arbitrator renders an award. Courts are not involved in and do not oversee arbitration. Premise is that this most likely lead to the truth. Types of attorney"s fees (hourly vs. contingent fee). Plaintiff"s complaint: jurisdiction, facts: allegations of what happened and how a legal wrong, prayer: court relief. Service of process: plaintiff serves defendant with complaint and summons, law & motion: motion to dismiss/summary judgement in lieu of answer, answer, default judgment for plaintiff if defendant does not answer.
