Or their counsel are not present; no judge. Grand jurors are allowed to ask questions; allowed to ask prosecutor for more evidence. Their job is to decide whether there is probable cause ot believe that the committed the crime that is, enough evidence to hold over for trial. They issue either a true bill indictment goes out, or a no bill if there"s a no bill, prosecutor can gather more evidence and try again and again, and again, and again. Prosecutor does have a responsibility to give the jury the law that applies in the case. In this case, the prosecutor anticipated that self-defense would be an issue.
