Preventative law-aims to help parties to find solutions out of cour. t. Collaborative law- parties enter a contract, enforceable by penalties, not to start proceedings: the judiciary. Some decisions should only be made by courts: public policy matters (ex. Family relations (nobody can decide by himself to be now the mother of somebody else: punishments like imprisonment (should not be done by victims) There are principles recognized as suitable and necessary safeguards for a judiciary: institutional principles. Relate to the characteristics of the court system, which are essential for the proper administration of justice: juridical independence- is not influenced by the other powers. Judges are appointed for life- to make sure that they do not give a decision that favors the government only to not be fired.
