Retribution is 1 of the oldest systems: based on the idea of proportionality. Also sociopaths: pretrial diversion- putting people in some sort of training plus retribution in exchange for not going to trial. Incapacitation- the idea behind locking someone up: not what you want to do with most offenders, selective incapacitation- looking at individual cases for the severity of the crime & past criminal history, most extreme version is capital punishment. Restorative justice (aka restoration)- focus on the harm crime does to society; idea is to make criminals realize what they do hurts people: 1 size does not fit all though doesn"t work for everyone. Bifurcated system: 1st phase: guilty/innocent, 2nd phase: punishment. Past history is included, evidence not included in trial. Have to go before a parole board. Indeterminate sentences- a sentence where a parole board can determine whether or not someone has learned their lesson & can be paroled early: sentencing guidelines- can be a problem.
