Civil rights and liberties are ensured by the local and state government. Bill of rights federally but it is applied by the local and state government. Theory that has largely disappeared in the 21st century, did apply in the 19th and 20th century. Dual citizenship took a long time to go away. At the framing of the us constitution, there were many state constitution which included many state rights as in civil liberties and rights negative freedom (constitution protected you from government actions) Most states prior to bill of rights had their own rights. Difference between state and federal constitutions bill of rights: states had different combination of inerumerated rights. Federal government did not allow religious tests but the states did. 5th amendment self-incrimination (only 7 of the 13 states had this) Most states had free speech (only half had free press) Not all states had the same civil liberties.
