On august 6, 2015, there was an order granting the defendant, p. f. Phillips filed a first amended class action complaint, dkt no. 25 alleging under the california law that the defendant discriminated against phillips as well as other with celiac disease. Before the restaurants motion was dismissed, the plaintiff filed an opposition. The court held a hearing for this case on october 30, 2015 in which the court denied the motion to dismiss. Phillips originally sued the restaurant in 2014 claiming there was a surcharge that was applied to the gluten-free menu items with the americans with disabilities act (ada) in which she was charged extra for.
