1/26/18: classifications of law, criminal law, dangerous behavior outlawed by society, government prosecutes accused, guilt is determined. Punished or fine imposed: civil law, regulates rights and duties between parties, victim, not government brings suit, guilt not determined, compensation, or equitable relief, is ordered, substantive law, defines the rights of the people, procedural law. Established processes for settling disputes: public law. But this violates most people"s moral standards today: four sources of law, constitutional law. Judge made (judicial) law; made up of all the decisions made by appellate courts. Incorporate predictability and flexibility: changes in common law, over time, changes in society"s norms have an effect on long standing common law. We elect the state congressional representatives and the united states senators and representatives. Federal agencies such as the federal aviation agency and the federal trade commission and the bureau of land management, have the power to make regulations: agencies were - and are - created to fulfill a need.
