Male, female, & at least 3 different intersex categories. There are gradations that we can see & study that the law ignores. Herms = true hermaphrodite, have both egg & sperm producing organs. Merms = male pseudo-hermaphrodites, have testes & some aspects of female genital, but no ovaries that produce eggs (male xy chromosomes) Ferms = female pseudo-hermaphrodites, have ovaries & some aspects of male genitalia, but no testes that produce sperm (female xx chromosomes) Law ignores the many gradations from female to male, requiring a binary. Each of these has number of other variations. Fausto-sterling uses the example that among about 6,000 students at brown university. > about 250 intersex individuals on the campus (about 4%) The legal system requires that newborns register as male or female on birth certificate.
