Federalism : a form of government in which a written constitution provides for a division of powers between a central government and regional governments. Only 1% of entire docket actually goes to trial. Most are out before it gets to court. Paradox: crime control model vs. due process model. Assure the constitutional rights of those accused of crimes, at the hands of both law enforcement officers who make the arrest and the prosecutors who prosecute the defendant in criminal court. 1960"s: series of supreme court decisions that extended due process rights to those accused of a crime. Earl warren: most progressive judge in supreme court. A caveat: the court weighs the constitutionality of plea bargaining.
