BLAW 3175 Lecture 4: Lecture4
Document Summary
What the judges want to happen effect decisions. Law and justice are not the same thing. Law is made up of these interpretations. Individual: most likely decrease, sleep, studying, and performance. Communal: distracting, could get others sick, bring down class average. Law is a tool that society may use to try to solve problems. However, it is not always the answer to every problem. Like every social system, it has strengths and weaknesses. Law is a rich, complex, and nuanced concept that defies simple definition. Its characteristics include enforceable rules adopted by a recognized authority with a goal of keeping social order. Law can make one do something or refrain from doing something but cannot make one think something. In order to be successful in maintaining order, law must evolve in keeping with social advancements. Law is not inherently just any more than a teacher is inherently right or a government leader is inherently wise.
