Warrantless, Mandatory, and Pro-Arrests: Prior to 1984, no warrantless arrests were allowed
unless the incident occurred in the officer’s presence or probable cause that a felony was
committed. Now, all states have warrantless arrests, and revised statutes have increased the scope
of relationships and the acts covered as family violence crimes net result is an increase in
police authority. The intent of mandatory and preferred arrest policies is to relieve the victim of
making the arrest decision
Potential Lethality: Dangerousness - Life-threatening intimate partner violence involving
physical force causing severe injuries that could easily result in death
Cleary Act: Universities must train staff to prevent and report domestic and dating violence and
stalking, including sexual assaults.
VAWA: Violence Against Women’s Act – Created first National Domestic Violence Hotline.
Addressed structural impediments to state-based laws. Federal felony to travel across state lines
to injury intimate partner or violate terms of restraining-protective orders (full faith and credit).
Strengthened federal penalties for repeat sex offenders and included “rape shield laws.”
Encouraged coordinated community responses. Offered legal protection to battered immigrants
Created funding streams for the Department of Justice, Health and Human Services, and the
Centers for Disease Control and Prevention. Extended policies and funding for elderly victims,
those with disabilities, and dating violence. New focus on domestic violence, dating violence,
and stalking on college campuses
