Federal Regulations and Key Principles
Four Parts of IDEA
Part A – General Provisions

Part B – public special educational system
Part C – infants and toddlers with disabilities

Purpose of Part C Legislation:
Enhance development of infants and toddlers with disabilities

• A big chunk of the money comes from Medicaid
• Some comes from TEA and TANF,
Part B versus Part C:
Part B
• Free and appropriate public education
o Before IDEA, it was recommended children with disabilities were
institutionalized.
• Least restrictive environment
o Where the child is at the time of service
• Individualized education plan (IEP)
• Educational need
Part C
• States allowed to charge families for fees for some services
o Not free, and states have option to charge families
• Natural environments
o Service comes to where child is during the day
• Individualized family service plan (IFSP)
• Developmental need
o Medical diagnoses
o Developmental delay
Required Components of Part C State System
Rigorous definition of developmental delay
• Child must have a 25% developmental delay in any one area (Texas definition)
o Texas is known as one of the broader definitions
• In some states, children must show a 50% delay
Early intervention services are available to all infants and toddlers with disabilities and their
families
• There are no waitlists.
Timely, comprehensive, multi-disciplinary evaluation
• Timely – cannot let people wait around, plan has to be done within 45 days
