Document Summary

The following questions are meant as a study guide for the final. These questions do not exhaust the topics you might be asked about on the final. The review sheet does not cover every reading that was assigned, and it does not cover every reading that you will be responsible on the exam. With the exception of the last two articles (healy, simon) you are responsible for everything in the course reader. The supreme court did not uphold it because it distinguished between non- violent and violent offenders. Had it included all felons, it would not violate the equal protection clause, which was part of the 14th amendment. The purpose of mandatory minimum sentences is to prevent the judicial trivialization of serious drug crimes. Before the advent of mandatory minimum sentences in serious drug cases, federal judges had unbridled discretion to impose whatever sentences they deemed appropriate, in their personal view, up to the statutory maximum.
