Criminal procedure reading notes introduction to criminal procedure. Criminal procedure is the rules on how criminal offences can be investigated, prosecuted, and tried. Responsibility for investigation rests largely on police. Initiated by complaint from member of public or as result of police detecting it themselves. Police usually are ones to press charges as well. Victim cannot veto decision although police will take it into consideration. Prosecution lies within crown attorneys of ces. (canada does not have district attorneys, or das) Crown attorneys are lawyers paid by government. They look at case and decide if prosecution is warranted. if not warranted, they take away charges, if warranted they prepare case for trial. Have to give all the evidence to the accused. They don"t argue to convict the accused, they argue for justice to be done (they can argue for an acquittal) Accsued doesn"t have to give their evidence over though, (with some exceptions.
