One role of a police oicer is to enforce the criminal law. In this sense, the police are the gatekeepers to the criminal jusice process: the decision to arrest a person triggers the criminal jusice process. Ater arresing someone, the oicer must prepare an aidavit for the courts review. This aidavit does two things: first it outlines the details surrounding the criminal event. The oicer must explain how the incident matches the elements of the crime being charged: second, the oicer also tells the court what informaion he or she used to formulate probable cause. This chapter focuses exclusively upon the irst feature of the aidavit, the elements of a crime: the elements refer to the acions that consitute a paricular crime. The term mens rea means that the suspect has the ability to form criminal intent: certain classes of people are incapable of forming criminal intent.
