The challenge begins (is it legal or not?) The 5th amendment allowed capital punishment with strict guideline and due process. The 14th amendment outlawed acts that deprevice citizens or life, liberty, or property. 8th amendment outlaws cruel and unusual punishment. In the late 50s and 60s some politicians started to voice their opposition of the death penalty. Some states started having split trial systems for capital cases. 2nd trial for determining sentencing to keep each process separate. Deliberated if the death penalty is appropriate for a rapist considering they did not take a life (violation of the 8th amendment?) These questions posed by justice goldberg were his effort to either get the death penalty abolished or restricted. He personally was against the death penalty and felt it put minorities at a disadvantage. The naacp legal defense and educational fund lawyers. This team was put together in attempt to abolish racial inequality within the courts.
