Complaint and answer are given which usually help frame the issue the court will face during the case. If you cannot personally serve a defendant, you typically cannot continue with a lawsuit. Defendant is obligated to file an answer or responsive motion with the court. Default judgment if they do not answer. Counterclaim states a cause of action against the plaintiff. Motion to dismiss: no cause of action, lack of personal or subject jurisdiction, improper venue, or lack of standing. Motion of summary judgment: judgment based of affidavits and other sworn evidence in discovery. Parties present and argue their cases before a judge or jury who will decide the issues in dispute. Voir dire- to tell the truth finding the jury ( 1st stage of trial) Certain number of strickes they can use to kick bias jurors off. At any point during the trial, trial motions can be filed.
