Document Summary

Chapter 9: women in the judiciary: the legal disenfranchisement of women in american life lasted throughout the 19th-20th century. Women were the victims of discrimination in various legal forms. Women were viewed as property of their husbands. Women working outside the home were viewed as a problem to be dealt with. Women were banned from entering legal contracts and couldn"t file suit in a court of law: in 1975, taylor v. louisiana, the supreme court decided excluding women from a jury didn"t represent a jury of one"s peers. Women and the legal profession: in 1890, there were only 200 women attorneys. This dramatically increased the number of women attending law school: there are organizational, institutional, and systemic obstacles for women attorneys including gender based assumptions, lack of mentoring and family-work conflicts. Women attorneys often do not receive the same presumption of competence or commitment: subtle discrimination occurs in demographics of the bench, bar, and courtpersonnel.
