There is more than one way to define ‘crime’:
- Legalistic
- Human rights
- Social and political
Who is a criminal?
Is George Pell a criminal? Most people think so
Is Senator Derryn Hinch? Let too much information out, criminal justice system views this as a crime,
as it put into question if the trial’s were fair. 50-50
Is Edward Snowden? Intelligence, on the run from the United States, he revealed sensitive
documents about the military and defense. Espionage. Divided about 70%
It’s hard and perception, personal, can cause division over people who are criminals.
Is Sofina Nikat? Infanticide, need a psychiatrist’s note saying they were mentally unstable, and
therefore killed them. She smothered her trialed because she thought the infant was posed.
Is Kanye West? Attacked photographers.
Is Australian prime ministers? Treatment of asylum seekers. State crime.

No universal agreement. Changes through time. Change from place to place. It isn’t just about
causing harm. Culturally linked and very subjective.
What is crime? Changes over time
Used to be legal but now criminalized:
- Some drugs (heroin was legally available 1953)
- Smoking of public transport (2007)
- Rape in marriage (1981)
- Operating a tanning salon (2014)
Used to be criminalized but now legal:
- Mixed bathing (1940)
- Consensual homosexual sex (1980)
- Medical marijuana, under 21 drinking
