Medium upon which there is an inscription or writing (not capture a video or photo etc) = court gets to look at the document. Normally through a witness identifies | explains relevance & significance in the case. Eg documents used to refresh memory are produced to the court. = putting into evidence & make available for consideration. Must establish relevance and admissibility: relevance usually covered by witness, admissibility if witness" signature on doc then not hearsay. Is considered to be the evidence of the witness incorporated into testimony. Not considered a statement from the witness box. Expert reports ucpr provisions [ expert opinions] Must prove : the document is original (best evidence rule) Note exceptions: the document is authenticated, best (original) evidence rule. Rationale: left with jury so weighty evidence, provide the best evidence, avoid fraud & deception. Dr x not used to establish that blood was y"s due to objection q"s testimony = secondary |
