Traditionally, unions and works do not want price of labour to be decided by free market. But in nhl, the players push for a free market priced wage; owners want to control wage. This is seen in salary cap, which players don"t actually want. Ontario hockey league (ohl), western hockey league (whl), and quebec major junior hockey league (qmjhl) These players do get paid for weeks they play (may not be a lot but they are paid share of revenue earned) Many obligations (practice, games, promotional events, curfews, etc. ) Ex/ canucks and bc provincial labour law. These can show that junior hockey players are employees. Cannot include coaches because they exercise management responsibilities. Many of these players desire to make it to the nhl, don"t want to upset employer. Judicator stated allowing 1 team to be unionized would result in labour instability. Some teams are under state legislation and northwestern is under federal, more instability.
