Study how norms are used, norms of behaviour, how they are formed, norms of sancions, how are they formed who decides what is criminal and what is not. Above all, penal pracices are shaped by the condiion of the lower classes and the strategies adopted towards them by the governing lite. Punishment forms a key part of the policing and social policy measures which together regulate the poor and seek to manage problem populaions. Karl marx (1818-1883) replaces criminal law with a wider project of recogniion framing the police as an instrument to control the poor, pacify public space. Serves to protect the interests of the powerful and is ied to private property. Criminal law cannot be just with capitalism as it is one key instrument to which private property is dependant.
