Defendant has opportunity to contact legal council, always told to remain silent and talk to your lawyer rather than the police. If released they will get a court date. Often in serious cases such as homicide, the accused remains in custody for the duration of their case. Can decide if they want to go to trial or plead guilty with the advice of their lawyer. If not guilty, accused is released from custody. If guilty, the next step is sentencing which prescribes a consequence for the offense.
