There is no blame or person at fault, but if someone if injured they will receive benefits from a fund. There are exceptions such as those who work from home. The federal legislation will compensate you according to the benefit scheme set out in your jurisdiction/ province. Each jurisdiction has their own body that disperse funds and deal with claims. In the majority of these jurisdictions, the first level encountered is the board, and then it is the appeals board. Only get to court if there is judicial review. In exchange for receiving guaranteed no-fault benefits whenever a worker suffers a work-related injury, workers would relinquish the right to sue their employers for damages.
