The extent to which our criminal system is operating in an equal way. Michigan water crisis: former auto motor town, the plumbing has fallen into disrepair, cities water crisis, 2 worker charged for contamination, water laced with lead. Who does the rule of law apply too: the rule of law does apply to heads of states however there is a doctrine of immunity while they are in power. Once they are no longer in power they then can be charged for crimes committed in office. Actus reus- voluntary action- found in a criminal offence in the provision. Regulatory liability: when we talk about regulatory liability they are not considered to be true crimes, mala prohibita- not as morally blamed as other offences, less concern with knowledge of the accused, lower mens rea. Strict liability offences: regulatory, not taken as seriously, but an have very serious ramifications- water crisis. Week 4: when we talk about environmental issues it becomes very relevant.
