Document Summary

Case brief: na(cid:373)e of the (cid:272)ase (cid:862)r. (cid:448). It makes this case influential in some other completely different case (reasoning of a murder case could be used in a fraud case, for example). Mode of trial: (where does a trial take place?) It is possible to skip the preliminary inquiry. If you do not show up to court date, there can be a warrant for your arrest (a bench warrant): s. 509: summons. 515ff: undertakings before officer in charge, show cause hearing (bail hearing). Grounds of detention: primary: that the accused is proven to be a flight risk likely to not show up in court. The crown has to prove this, perhaps by acknowledging that the accused does not have any family, job or residence in the area of the commission of the offence: secondary: risk to the public. If the accused is likely to reoffend, then they can be detained.
