Going to trial allows for more problems to arise for the youth such as continued records if they do(cid:374)"t (cid:272)o(cid:373)ply a(cid:374)d it keeps them in the criminal justice system for longer time. Crown attorney makes the call who will be diverted: nobody else has say even the judge. Diversion can happen at any point in the process. Legislation urges the crown to seek diversion as much as possible: used to see a lot of diversion but not so more. Allows young persons to be dealt with in a formal way. Allows cases to be dealt with quickly and the young person to avoid ending up with a criminal record. When it came out it was being used more frequently.
