This takes the young person off this track and away from trial. Going to trial allows for more problems to arise for the youth such as continued records if they do(cid:374)"t (cid:272)o(cid:373)ply a(cid:374)d it keeps them in the criminal justice system for longer time. Crown attorney makes the call who will be diverted: nobody else has say even the judge. Diversion can happen at any point in the process. Legislation urges the crown to seek diversion as much as possible: used to see a lot of diversion but not so more. Allows young persons to be dealt with in a formal way. Allows cases to be dealt with quickly and the young person to avoid ending up with a criminal record. When it came out it was being used more frequently.
