Impartiality....they cant go out in the media and offer advice and stuff...thats one
of 3 things that limits judges
Judicial independence......prime minister cant tell judges to go arrest this person
whatsoever or anything similar to that...they’re independent.
Equality before the law......lawyers are expensive so like some people cant
afford...so to solve this problem there is Equality before the law so there are legal
programs that help people find support to fight a lawsuit etc....
Canadian court system: there is a hierarchy...see figure 8.1....just keep this in
mind..not too important but do keep it in mind..
There is a federal dimension in our court system
Common law vs. Civil law....all of Canada except for quebec follows tradition of
the common law...whereas quebec follows civil law system. Basically the
difference is common law is a collection of precedents from previous cases... Supreme court....highest court in Canada. It has the power to basically choose
what cases they want to hear...usually they hear about 100 a year.
