Out of court settlements/ceasing to act (this was a very small chapter of only 3 pages) Settlement negotiations can occur at any time during the civil litigation. The out of court or informal" process may be negotiated through a series of letters, phone calls, meetings . After a statement of claim has been served, up to 10 days before trial date has been set, a party can serve another party with a formal offer to settle. Offer is not filed and offers must be kept open for 2 months. Parties must consider and engage in one or more dispute resolution processes unless it is waived by the court. Costs can be avoided if settled during dispute resolution rather than trial. Typically lasts half a day to a day. Voluntary and must be agreed upon by all parties. All statements are confidential and made without prejudice. Court does not charge a fee for this service.
