Rule of law: derived from magna carta; no one is above the law (social contract both must act in concordance with the law); we agree to be ruled by laws rather than the whim of authority. Government must act in accordance with the law. Magna carta: king cannot act on taxation without consent of noblemen, symbol of rule of law. Canadian law system inherited from england (english bill of rights) Substantive law: establishes rights and duties (ie wills and estates act, criminal code) Procedural law: laws that operate as a mechanism to institute rights and duties. Public law: rights of government and individual (murder trials, reckless endangerment) Private law: referred to as civil law, laws enforced by one individual against another.
