Document Summary

Legal pluralism is the complete opposite of state homogeneity. That is, the idea that the state is built of one culturally unanimous people. Oten rejected and repressed in favour of state unity. For example mali, a country with widely varying faith, ethnicity and culture, adopted the slogan one people, one goal, one faith , which in reality contrasts to the reality of the country. Legal plurlaims becomes apparent when muliple jurisdicions clash. For example, when internaional, supranaional (such as the eu) and state law overlap. When first naions legal claims fail in the canadian court system, they are able to take those claims to the united naions and reassert them. Patrick glen teaches that western law is just another tradiional law. Puts western law beside and not above other legal systems. Exclusivism: irreconcilable, mutually exclusive forms of law. Legal pluralism doesn"t always mean the easy/peaceful coexistence it is someime to romanicized to be, and is not always posiive.
