Justice systems put in place to keep people accountable. Sierra leone trc: foster reconciliation between perpetrators and victims, more victim centered, responsibility. Special court for sierra leone: to prosecute those who bear the greatest responsibilities. Scholarship now beyond justice vs. peace or restorative vs. retributive. Should be where you have to choose one vs. the other. Both models of transitional justice at the same time is possible. Amnesty in the lome peace accord: amnesty: one of the mechanisms in restorative justice, amnesty is a conflict resolution tool, often given to warlords and oppressive leaders to sign a peace agreement (or go away) An unfortunate message to combatants in future wars that they cannot trust peace agreements that contain amnesty clause. There will be circumstances where a trade of peace for amnesty represents the least bad of the available alternatives (trc report, vol 2:2) Want people to be held accountable, need to send a message.
