I decide to sue b and seek from the court an order that damages be paid to e: a v. b scenario, where a seeks a judgement that would benefit c. I can"t do that: simple explanation: i"d be seeking a judgement that, if granted, wouldn"t benefit me personally. Imagine that the aggrieved person is vulnerable and doesn"t have : the implications of that requirement are based on fundamental implications of privacy, personal autonomy and self-determinacy. It"s our private rs that are being aggrieved. But when we stick to private remedies & private law, it"s up to us to determine whether we go forward w/ a lawsuit or not: applies to courts: the court cannot create a case.
